now. at 11, san jose's mayor, speaking for the first time since two of the city's police officers were shot. we're live with new details on the man. investigators say is at the center of the shooting and missed the scary moments for one woman overnight. good morning and thanks for joining us for our midday newscast. i'm marcus washington and i'm kris sanchez laura garcia is off. we begin with that breaking news in san jose with new developments into the shooting of those two police officers. at this hour, we are waiting for the city's acting police chief to deliver updates on those two officers who were shot last night. now, investigators say the pair were responding to a disturbance at the time. nbc bay area's bob redell live for us from the shooting scene, this is along san ignacio avenue. now, bob, we're more than 12 hours since that all took place. do we understand? at least we have understanding that you have an update on at least one of those officers. correct. we do. good

morning to you, chris and marcus. a source with knowledge of the investigation tells nbc bay area news that one of the officers who was shot at this hotel behind me is a rookie who just completed probation. the other officer who was shot is also young, but not clear if they too, are a rookie. the acting chief of police, as you mentioned, will be holding a news conference on a couple of hours. but here's what we know so far. last night, a woman here at the extended stay america hotel. this is on san ignacio avenue in south san jose, called police to report a problem with a man. the call came in as a disturbance. police arrived and they couldn't find him, so they left. she called a second time, and when officers arrived that time, that was around 1030 last night. they made contact with the man who opened fire on the officer and officers and hit two of them. the officers fired back and hit the man. here's a woman who is staying on the third floor of this hotel, where she says the shooting took place. we

were actually asleep and i thought i was dreaming and heard, like, fireworks. and then all of a sudden, about two minutes later, bam, bam, bam. and i'm like, okay. i thought it was my friend or my daughter's friends. so i go to the door to yell at them and it was the cops. and i'm like, what's going on? is everybody okay? i'm like, yeah, it's a welfare check. i'm like, everybody's fine. what's going on? go shelter in place, lock your doors, stay down as low as you can, and then we'll be back to talk to you. and about an hour and a half later, they came back and said that it was an officer involved shooting and took all our information. this is a live look at san jose regional medical center, where that rookie police officer who was shot is in critical but stable condition. the suspect also at regional med, also in critical but stable condition. a source tells us the suspect is 33 years old, has a criminal history and had an outstanding arrest warrant for alleged, rape and domestic violence. the

second officer was taken to valley medical center and was treated and released overnight. so again, we are waiting for the acting chief of police to hold a news conference at 1:00 this afternoon at san jose police headquarters reporting live here in south san jose, bob redell. nbc, bay area news. it's good to know at least the suspect is off the streets for the time being. thank you bob. now, during an event this morning, san jose mayor matt mahan said that that shooting is a reminder of the courage it takes for officers to protect the city every day. there are no words that can convey how grateful i am that both of our officers have made it to see the morning i'll be joining acting chief paul joseph later this afternoon to share more details as they become available. and in the meantime, i want to make sure that our officers and their families know that we are thinking and praying for them. meantime, other police departments taking to x talking about the officers that were shot today, sunnyvale police

60s. this is the cold front that's coming in and it's making its way closer to the bay area when it arrives, it will bring in a big drop in temperatures and some of our early estimates for tomorrow's rain is about a half inch up to an inch of rainfall, as well as much cooler temperatures, the highs in the 50s and 60s, and it will be windy at times, with 20 to 30 mile per hour winds. and the sierra this weekend is looking at 1 to 2ft of snow. we'll time it all out for you as you're making weekend plans. we'll talk about a much improved forecast for sunday that's coming up in a few minutes. kris marcus. thanks, gary. well, trump media's auditing firm and its owner face massive fraud charges and the securities and exchange commission just made that announcement this morning. the auditor bf borgers, cpa, and its owner, benjamin borgers, agree to a permanent suspension as practicing accountants by the federal regulator. as a result. now, they also agree to pay a combined $14 million in civil

penalties. the sec says that their work affected more than 1500 sec filings. new overnight, a fire ripped through a home in san leandro is just remarkable to see how big those flames are. it happened shortly after 10:00 last night on 167th avenue and los banos street. firefighters were able to contain that fire within 45 minutes. no one was hurt. but we do know that two people were displaced, and the red cross is now helping that family. and investigators are looking into the cause of the fire. six months after fire destroyed a popular east bay barbecue restaurant, firefighters now reportedly confirming that this is a case of arson. the fire happened at horne barbecue in oakland last november, and just last week the restaurant reopened in a new oakland location. but investigators always considered this fire to be suspicious, and they have new evidence that they found at the scene indicating someone set that fire on purpose. however, so far there are no suspects. well, despite

new clashes on campuses outside the bay area, pro-palestinian supporters at uc berkeley appear to be steadfast in their tent protests. video shot last night showed demonstrators holding hands, dancing and chanting, a far cry from one incident just two days ago. that's when police say three people were injured when someone grabbed a flag held by pro-palestine pro-israeli supporter leading a scuffle in sproul plaza. palestinian supporters on campus now tell nbc bay area that incident involved someone from outside their core protest group. uc leaders at this time still have no plans to involve police unless safety of students is threatened. well, as for those protests elsewhere, thousands have been arrested this week in new york city. police there now confirm one officer accidentally discharged his gun. this is while clearing protesters at columbia on tuesday. no one was injured. now, according to the tally by nbc news, law enforcement arrested more than

2100 people at pro-police protests across the country in the past two weeks. that includes more than 200 arrests by chp about 24 hours ago on the campus of ucla, students there are calling for universities to divest from israel and the war in gaza to end. president joe biden says that he supports freedom of speech, but it is not the right to cause chaos. peaceful protest is in the best tradition of how americans respond to consequential issues. but but neither are we a lawless country. whereas civil society and order must prevail. now, we asked if demonstrations have forced him to reconsider any u.s. policy in the middle east. president biden simply said no. the biden administration is urging hamas to agree to a current cease fire deal on the table. as those protesters continue to make their voices heard. israel and hamas militants appear to be seriously

negotiating a cease fire in gaza and the return of israeli hostages, nbc news ralph sanchez is on the ground in tel aviv. for days now, israel, the us and the world have been waiting for hamas to respond to the current cease fire proposal. but hamas, not yet giving a definitive answer, instead saying it will send negotiators back to cairo as soon as possible to continue discussions and try to finalize an agreement. now that is positive on the one side, but also an indication that hamas is not yet ready to give an answer either way, israel says time here is not unlimited and that despite american opposition, it is preparing to move ahead with an assault on the city of rafah. now, more than a million palestinian civilians are sheltering there. the white house says any attack would be a disaster, but israel says it has no choice. it needs to go into that city and destroy the remaining hamas battalions who

are hiding there. there is, at this point, more aid getting into gaza than before. that's partly because israel has opened up a new crossing under intense american pressure. the white house also says that it is just days away from the completion of an american military temporary pier off the coast of gaza, which is designed to bring more food in by sea. secretary of defense lloyd austin overnight saying at this point the us does not have any intelligence that indicates that hamas would attack american forces manning that pier. but he pointed out that this is a battle zone and it is an unpredictable situation . ralph sanchez, nbc news, tel aviv well, ensuring funding for victims of sexual abuse ahead for sunol midday newscast. we're going to tell you the reason advocates fear that critical decision could lead to hundreds of millions of dollars being cut. plus, cinco de mayo is

it is the case of a woman who was found unresponsive in her own home by her husband and her

12 year old daughter. they called 911, but it was too late, and while this looked like an accidental fall, there were a lot of unanswered questions that haunted investigators for years. susan sill's family tried to move on, but her mother struggled with her daughter's improbable passing. i spoke with dateline keith morrison about how investigators made that connection between suzanne's fall and what wasn't an accident, but then the question was, had somebody done something to her first, did she really fall down the stairs, or had she been placed at the bottom of the stairs, having been killed elsewhere and all of that depended on what the medical examiner could say, after a series of tests which took a long time, and in the meantime, everyone assumed it was an accident. tune in tonight to learn more about the investigation into susan sill's death. dateline new two hour if these walls could talk airs

tonight at 9:00 right here on nbc bay area. well advocates for sex abuse and sex trafficking victims say time is critical to preserve much needed funding. now the fear is the white house will soon cut hundreds of millions of dollars from the crime victims fund, first established by the victims of crime act. in a recent op ed published in san jose spotlight, one santa clara county victims rights group says that it may lead to $2 million in cuts locally starting in october. now, they're urging governor gavin newsom and state lawmakers to cover the shortfall. we spoke with community solutions out of south bay, the nonprofit expects to lose nearly 20% of its funding, barring a rescue plan, because we don't want to turn anybody away, particularly when they're in need, when they're fleeing an abusive situation, we're going to have to reduce the breadth and depth of services and again, going back to band-aid solutions, that is not going to be supportive to any maybe in the immediate crisis it might help, but it's not going to support any long

term impact or change or help survivors get to a place of healing and security. now, there is one bill currently working its way through the legislature. it will indeed bridge the gap, but it is still in the committee stage. a very prestigious honor for longtime bay area lawmaker nancy pelosi. she is now one of the latest recipients of the presidential medal of freedom. the medal is considered the united states highest civilian honor. among the other 18 names on the list, former vice president al gore and actress michelle yeoh, who recently became the first asian american to win oscars best actress. also two stanford connections. one is olympic swimmer katie ledecky and the other is civil rights activist and scholar clarence b jones. the recipients will receive their awards at the white house later today. all right, let's take a live look out at downtown san jose, which is going to be a lot busier this weekend with not one, but two cinco de mayo parades and festivals happening pretty much

at the same time. the city faced some criticism last year when police closed several streets and off ramps and businesses say it really made it hard for them and their sales. parade organizers promised that this year, things are going to be different. for one, police are part of the festivities and also leaders are promising more police patrols and greater outreach. we are communicating more than ever doing you know, partnering with members of the community, with the small business owners and for the first time doing a city sponsored parade and cruising event. councilman domingo candelas, who you just saw was among those who criticized the police plan last year. but he says while you can expect more road closures this weekend, the decisions about where those closures are were made with community feedback. the downtown festivals happen on sunday at city hall and at plaza cesar chavez. both start at nine in the morning. nbc bay area is a sponsor, so watch out for our

we've had all week long to more chilly and rainy, windy weather for tomorrow, but it will be drying out on sunday. still kind of cool though. and then for the sierra, we're going to see snow showers coming in. we're expecting 1 to 2ft of snow in parts of the sierra. so if you're traveling there tomorrow, you might want to hold up until sunday. if you can't leave today, and we're going to see temperatures across the bay area still in the 70s for many of the inland valleys, with san jose up to 77, concord 78 and 75. in napa, 77. in santa rosa and in san francisco today, 64 degrees. but then take a look at tomorrow's highs. we're only up to 59 in san mateo and in oakland, 57 in livermore. definitely a big chill out there and only slightly warmer as we return to sunshine on sunday. once again, here's a look at the storm system that's now making its way into the pacific northwest. and this is a fairly strong storm system for this time of year. we're going to start to see the rain coming into the north bay right around

sunrise and getting heavier as it continues to spread across the bay area going into late morning into the afternoon. eventually it's going to taper off tomorrow night and we're looking at some pretty high rainfall totals, keeping in mind that our normal monthly rainfall for spots like santa rosa is about an inch of rainfall. and we could see all of that in this one storm coming in, usually in san jose, we get about 3/10 of an inch of rainfall through the month of may. so this one's also kind of overindexing with what we'll see for tomorrow. so we'll see if we actually get that amount of rainfall. but it looks fairly decent there. and a big snowstorm for the sierra once again 1 to 2ft possible. and it could come all the way down to 4000ft in elevation, where we see that snow developing. but we are looking great for the cinco de mayo parade and festivals going on in san jose on sunday. temperatures in the low 50s to start and only making it into the low 60s. so we will need to stay bundled up, but at least on sunday we won't have to worry

about rain. we're warming up next week and it will feel definitely more like spring with some mid 80s by the end of the week. while in san francisco we'll only see a high of 56 tomorrow. but then we're back to the low 60s for early next week. back to you, marcus and chris. all right. thanks, gary. well, you know, 23 years ago, an east bay comic book shop started a movement. well, now that comic store is getting ready to close its doors. tomorrow marks annual free comic book day. it's a now a global phenomenon. and it all started at flying colors comics. this was located on oak grove shopping center in concord, so the actual store opened back in 1998. the owner says that event really helped unite the comic book industry. was actually very surprised that it came off the way it did, the comic book business tends to be a, one in which everyone does their own thing and doesn't come together all that often, but with free comic book day, the entire

industry came together to do something good and move us all forward. now the store is expected to close early next year, but there is hope that it will open somewhere else. by the way, that event, if you're interested, will start tomorrow at 11 a.m. happening now. the economy added 175,000 jobs in april, which is below the forecast of 250,000. the unemployment rate holds steady at 3.8. wall street says that it is encouraging to see the labor market cooling a bit, and wage growth starting to slow down. okay, so why would you go all the way to churchill downs to celebrate tomorrow's 150th anniversary of the kentucky derby? i don't know why you would, but if you stick around, we're going to tell you the one place right here in the bay area where you can actually be sure to drink it alln and have some i

event tomorrow, but take a listen to what's going on. yes, you will enjoy large screen viewing of the races throughout the day on these giant 16 by nine led screens, then we'll also have derby inspired cuisine, from local restaurants, paired with our award winning wines, of course. and then musical entertainment between the races ut the day. what do they say? it'the fastest event in sports. if you're not going, you can watch the kentucky derby right here on nbc bay area starting at 1130. so it's good that they have all the other stuff planned, carrie, because that race is over fast. yeah, but there's many other races that go on throughout the day, so it's kind of a full day. but then you focus on the one race. yeah all right. so we're going to have some rainy weather for our saturday. it's also going to be much cooler, about a 20 degree drop in those highs. and it is going to be very chilly on sunday and monday mornings. we may even see some
